For companies whose business is based on product development, a clearly defined patent strategy or IPR strategy is just as important as a strong business strategy. However, it is essential that the IPR strategy supports your company’s business strategy in the best possible manner. A good IPR strategy is one that secures the company’s market position and creates true value for the company.

An IPR strategy may also be important for other types of companies, e.g. trading companies that import technical products that may be patent-protected. Here it is especially important to ensure that you do not risk patent infringement.

Offensive or defensive strategy?

A patent strategy can be predominantly offensive, with an emphasis on preventing competitors from exploiting the company’s own technology and inventions. Conversely, a patent strategy can be predominantly defensive, with an emphasis on ensuring that the company can exploit its own technology and inventions without risking infringing the rights of others.

A plan for handling of ipr

An IPR strategy can be said to be a plan for how the company manages its IPR, ie. intellectual property rights, such as e.g. patents, utility models and design rights. The strategy can be general or more detailed. It should be written down and include procedures to be followed, in the same way as e.g. a quality control manual, so that you do not forget to consider important steps along the way.

The strategy should typically include guidelines for potential patent protection of own products, e.g. by defining procedures for collecting and evaluating new inventions in the company. In addition, the strategy should include guidelines on how to take account of the rights of others. For instance, a monitoring system can be established to detect patents of potential competitors and in relevant technical areas.
